The legal basis for the processing of this data is Article 6, paragraph 1, letter f) GDPR, Article 7, paragraph IX of the LGPD, and Article 15 of the LFPDPPP.
The necessary and voluntary data entered during registration (see point 2.2.) will be deleted when the account is deleted, unless there are legal provisions that prescribe longer storage.
Regarding the elimination of cookies, please refer to the explanations found in point 2.3.
The legal basis for the processing of anonymous data is Article 6, paragraph 1, letter f) GDPR, Article 7, paragraph IX of the LGPD, and Article 16 of the LFPDPPP. Our legitimate interest consists of the principle of data minimisation established in Article 5, paragraph 1, letter c) GDPR, Article 6, paragraph III of the LGPD, and Article 11 of the LFPDPPP.
On the website of Un Ensayo para Mí, users have the option of subscribing to a newsletter on a selected topic, as well as current studies. To do so, the user must give his or her consent in accordance with Article 6, paragraph 1, letter a) of the GDPR, Article 7, paragraph I of the LGPD, and Article 8 of the LFPDPPP for the processing of his or her personal data relevant to this.
If you subscribe to the newsletter, the data stored in your user profile (e-mail address) is processed as required and voluntary (see point 2.2 above) for the purpose of sending the newsletter, with formal personalisation (first and last name) and content (e.g. postcode and the main study-related interests mentioned by you). You consent to subscribe to the newsletter in accordance with these data protection provisions and the processing processes mentioned above.
The legal basis for the processing of user data is in accordance with Article 6, paragraph 1, letter a) GDPR, Article 7, paragraph I of the LGPD, and Article 8 of the LFPDPPP.
The user has the right to revoke his or her consent at any time without affecting the lawfulness of the processing carried out prior to that time based on the consent. Such a declaration can be made via a link in the newsletter; otherwise, the user has the option described in point 8 of contacting the responsible body. In the event of revocation, the user will no longer receive the newsletter.
The website of Un Ensayo para Mí may not only be used for general information about clinical studies, but registered users may also apply to participate in a study (“Study Application”). An application for a study requires explicit consent to the processing of data in connection with the application for a study within the meaning of Article 6, paragraph 1, letter a) GDPR, Article 7, paragraph I of the LGPD, and Article 8 of the LFPDPPP in conjunction with Article 9, paragraph 2, letter a) GDPR, Article 11, paragraph I of the LGPD, and Article 9 of the LFPDPPP. Consent must be given for a specific study. In the case of applications for several studies, a separate consent must be given for each study.
When requesting a study, personal data is requested from the user insofar as it is relevant to the user's suitability for a particular study. In this respect, this usually also concerns data relating to the user's health ("special categories of personal data" within the meaning of Article 9 Paragraph 1 GDPR, Article 11 LGPD and Article 9 LFPDPPP). The user makes the corresponding data available to Un Ensayo para Mí on the basis of an explicit consent given voluntarily and with knowledge of these data protection provisions. Without knowledge of the requested data, Un Ensayo para Mí cannot, under certain circumstances, offer certain services and offers in general or in full.
The legal basis for the processing of user data is in accordance with Article 6, paragraph 1, letter a) GDPR, Article 7, paragraph I of the LGPD, and Article 8 of the LFPDPPP, in connection with Article 9, paragraph 2, letter a) GDPR, Article 11, paragraph I of the LGPD, and Article 9 of the LFPDPPP.
The user data collected in connection with the application for a study is stored by Un Ensayo para Mí in the user's personal profile and processed for the purpose of checking the user's suitability for the study in question. The data will also be used for communication between Un Ensayo para Mí and the user in connection with the application process. Finally, the user's data, if the user has given explicit consent to its disclosure and appears to Un Ensayo para Mí to be suitable for the study, will be transmitted to one of the centers associated with the study. The disclosed data may be used by the study center to contact the user. In addition, the data stored by Un Ensayo para Mí may be presented for further information on the status of the application ("Status Information"). Un Ensayo para Mí uses this information exclusively to help the study center managers contact the user and/or to evaluate the user's application, as well as to perform statistical evaluations (see point 5 below).
The legal basis for the processing of user data is in accordance with Article 6, paragraph 1, letter a) GDPR, Article 7, paragraph I of the LGPD, and Article 8 of the LFPDPPP, in connection with Article 9, paragraph 2, letter a) GDPR, Article 11, paragraph I of the LGPD, and Article 9 of the LFPDPPP.
The user has the right to revoke at any time with future effect his or her consent to the processing of his or her personal data for the purpose of requesting the study, within the meaning of Article 6, paragraph 1, letter a) GDPR, Article 7, paragraph I of the LGPD, and Article 8 of the LFPDPPP, without affecting the lawfulness of the processing carried out up to that time based on consent. Such a declaration can be sent by email to privacy@trialtech.es. In addition, the user has the option described in point 8 of contacting the responsible entity.
The user can also limit the revocation to certain data. Revocation - also limited to certain data - may result in the user no longer being able to use certain services (in particular, his/her application to participate in a study can no longer be evaluated).
Upon revocation, the data entered by the user will be deleted (see Section 4.1) unless there are statutory provisions requiring longer storage. If the user has limited the revocation to certain data, only the data affected by the revocation will be deleted.
If no revocation is made, the data will be processed within the time periods specified in the declaration of consent and then deleted.
The legal basis for deletion is in accordance with Article 6, paragraph 1, letters a) and f) GDPR, Article 7, paragraphs I and IX of the LGPD, and Articles 8 and 11 of the LFPDPPP. Our legitimate interest consists of the principle of data minimisation set out in Article 5, paragraph 1, letter c) GDPR, Article 6, paragraph III of the LGPD, and Article 13 of the LFPDPPP.
Un Ensayo para Mí anonymizes the data collected from the user and then uses it for statistical evaluations.
The legal basis for the processing of anonymous data is Article 6, paragraph 1, letter f) GDPR, Article 7, paragraph IX of the LGPD, and Article 16 of the LFPDPPP. Our legitimate interest lies in the principle of data minimisation and in our interest in optimising the inclusion criteria or the design of questionnaires for future studies as set out in Article 5, paragraph 1, letter c) GDPR, Article 6, paragraph III of the LGPD, and Article 11 of the LFPDPPP.
6.1. Un Ensayo para Mí has the right to make user data available to third parties with whom it cooperates to provide services (e.g. telecommunications providers). The disclosure of data is limited to the purpose of the collaboration and third parties cooperating with Un Ensayo para Mí have the right to use the data as long as it is necessary to provide services.
The legal basis for the described transmission of personal data is Article 6, paragraph 1, letter f) GDPR, Article 7, paragraph IX of the LGPD, and Article 17 of the LFPDPPP. Our legitimate interest is to improve our procedures and services.
6.2. Likewise, Un Ensayo para Mí may disclose personal data to third parties,
6.2.1. when the user has expressly given his or her consent (e.g. to a centre carrying out a study for which the user has registered). The legal basis is Article 6, paragraph 1, letter a) GDPR, Article 7, paragraph I of the LGPD, and Article 8 of the LFPDPPP.
6.2.2. when there is an enforceable or final court or administrative order for the publication and/or disclosure of data to third parties or when Un Ensayo para Mí, due to a legal obligation, also without such an order, is obliged to publish and/or disclose to third parties. The legal basis is article 6, section 1, letters c) and f) GDPR, articles 7, paragraph II and XI, and article 17 of the LFPDPPP. Our justified interest lies in the fulfillment of justified claims.
6.2.3. when publication and/or disclosure is necessary to prevent misuse of the Internet offer or individual services - in particular, infringement of the terms of use - in a manner permitted by law. The legal basis is Article 6, paragraph 1, letter f) GDPR, Article 7, paragraph IX of the LGPD, and Article 17 of the LFPDPPP. Our legitimate interest lies in the detection and prosecution of improper conduct.
6.3 Except as set out in this data protection declaration, Un Ensayo para Mí does not disclose user data to third parties without user's explicit consent.
The legal basis for the transmission of personal data in the case of explicit consent is in accordance with Article 6, paragraph 1, letter a) GDPR, Article 7, paragraph I of the LGPD, and Article 8 of the LFPDPPP.
The user has the following rights. The exercise of these rights will be processed immediately and will not have any detriment to the user.
Right to information (Art. 15 GDPR, Art. 18 LGPD, Art. 16 LFPDPPP): The user may - without having to pay anything - request from Un Ensayo para Mí information about what personal data is being processed, what its source is and for what purpose(s) it is being processed and - insofar as it is relevant - to which recipients or categories of recipients this data is transmitted. Requests for information made electronically will be answered electronically.
Right of withdrawal (Art. 21 GDPR, Art. 18 LGPD, Art. 8 LFPDPPP): You may withdraw your data for reasons arising from your particular situation, provided that the data processing is based on the legitimate interests of Un Ensayo para Mí or a third party (Article 6, paragraph 1, letter f) GDPR, Article 7, paragraph IX of the LGPD, and Article 11 of the LFPDPPP), as well as in cases where the data processing is carried out in the public interest (Article 6, paragraph 1, letter e) GDPR, Article 7, paragraph III of the LGPD, and Article 13 of the LFPDPPP). If the user submits a revocation, Un Ensayo para Mí will no longer process the data, unless it can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the user or the processing serves to enforce, exercise or defend legal claims.
To the extent that Un Ensayo para Mí processes personal data for targeted information purposes regarding the range of services offered by Un Ensayo para Mí (hereinafter “Advertising Purposes”), the user has the right to object to the processing of his or her personal data in connection with such purposes. In the event of objection to processing for advertising purposes, Un Ensayo para Mí will no longer process the user's personal data for such purposes.
Right to data portability (Art. 20 GDPR, Art. 18 LGPD, Art. 12 LFPDPPP): The user has the right to request the publication of the personal data that he or she has made available to Un Ensayo para Mí in a structured format that can be read on a normal computer, provided that the processing of the data is based on the user's consent (Article 6, paragraph 1, letter a) GDPR, Article 7, paragraph I of the LGPD, and Article 8 of the LFPDPPP) or the processing is carried out for the fulfilment of a contract signed with the user or for the execution of pre-contractual measures (Article 6, paragraph 1, letter b) GDPR, Article 7, paragraph V of the LGPD, and Article 12 of the LFPDPPP).
Right to rectification (Art. 16 GDPR, Art. 18 LGPD, Art. 16 LFPDPPP): If personal data is incorrect or incomplete, you may request that it be rectified or completed. A rectification causes Un Ensayo para Mí to be obliged to communicate the rectification to all recipients to whom it has transmitted incorrect data, insofar as it is not exceptionally impossible or is associated with a disproportionate cost.
Right to deletion (Art. 17 GDPR, Art. 18 LGPD, Art. 16 LFPDPPP): The user may demand the immediate deletion of his/her data if (i) the purpose of the data processing has become obsolete due to time constraints or for another reason, (ii) the processing is based on the user's consent and this has been revoked, (iii) the user has objected to the processing and no other processing has taken place, or (iv) the legal basis for the processing of the data is missing or omitted. Un Ensayo para Mí must, however, observe existing retention obligations and deletion obligations in the face of legitimate interests.
Right to restriction of processing (Art. 18 GDPR, Art. 18 LGPD, Art. 16 LFPDPPP): The processing of personal data must be restricted (i) while a data rectification denied by Un Ensayo para Mí is being verified, (ii) the processing was unlawful in the first place but the user has objected to the processing, (iii) after the purpose has been achieved and the user still needs the data to exercise legal claims, and (iv) while a user objection is being verified. For the duration of restricted processing, Un Ensayo para Mí will only process the data (i) with the user's consent, (ii) for the enforcement, exercise or defence of legal claims, (iii) for the protection of the rights of another person or (iv) for reasons of significant public interest.
Right of appeal (Art. 77 GDPR, § 19 BDSG, Art. 18 LGPD, Art. 18 LFPDPPP): The user has the right to contact a supervisory authority with appeals.
Right to revoke consent under data protection legislation (Art. 7, paragraph 3 GDPR, Art. 18 LGPD, Art. 8 LFPDPPP): The user has the right to revoke at any time any consent given to Un Ensayo para Mí for the processing of his/her personal data.
